Transportation law
Counsel for motor carriers, freight brokers, freight forwarders and logistics companies, from the contracts that move freight to the disputes that follow it.
Jencks Law, P.C. represents motor carriers, federally licensed freight brokers, freight forwarders and third-party logistics providers in transportation matters, including the preparation of intermediary contracts. We lead or co-chair litigation nationwide on transportation issues.
What we handle
- Broker-carrier agreements, shipper-broker agreements and other intermediary contracts
- FMCSA and USDOT operating authority, registration and compliance issues
- Cargo loss and damage claims under the Carmack Amendment
- Freight charge and payment disputes, including recovery of freight and tariff charges and demurrage and detention
- Claims against broker surety bonds (BMC-84)
- Double brokering and other transportation fraud
- Carrier-vendor contract disputes and motor carrier agency litigation
- Related litigation, including transportation bankruptcy issues
Cargo claims
The firm has litigated cargo liability claims on both sides of the motor carrier, broker and shipper continuum, resolving disputes over damaged or delayed cargo and collecting overdue freight charges. Cargo claims call for counsel who understand the insurance issues, defense strategy, case law and legislation such as the Carmack Amendment and the Federal Motor Carrier Safety Regulations. David has over 25 years of cargo claims defense experience for regional and national insurers.
Keeping current
Transportation regulation is changing quickly: operating authority and registration, English proficiency enforcement, broker transparency and new bills aimed at chameleon carriers. David is a member of the Transportation Lawyers Association and Delta Nu Alpha, and we track these developments in a recurring Regulatory and Legislative Update.
