Equipment finance
Structuring effective equipment transactions, and enforcing them when they go wrong.
Equipment financing can present numerous challenges, especially in a tough economy. Jencks Law, P.C. represents financial services companies, including independent leasing and finance companies, commercial banks and their subsidiaries and divisions, in a wide variety of domestic and cross-border transactions, including:
- Origination of true leases of equipment to operating lessees, and finance leases under Article 2A of the Uniform Commercial Code
- Origination of secured loans collateralized by equipment under Article 9 of the Uniform Commercial Code
- Workouts and restructurings of troubled equipment finance transactions, including those in bankruptcy
- Collections and enforcement of rights in default, including foreclosure on and recovery of equipment
- Litigation arising out of equipment financing documentation, or out of the use, possession and ownership of equipment
Our work also includes letters of credit, interest rate options, syndicated transactions, and intercreditor, participation and subordination agreements drafted on behalf of lead lenders.
For lenders financing tractors, trailers and other transportation equipment, we bring the same operational understanding of motor carriers that informs our transportation finance work.
