Terms of use and privacy

How this website may be used, how we handle email, and how we treat the information you share with us.

Last updated: October 2026

These terms apply to your use of the Jencks Law, P.C. website and to email you receive from the firm. By using the site, you agree to them.

Information only, not legal advice

The content on this website is general information about the firm and the law. It is not legal advice, it may not reflect the most current law, and it is not a substitute for advice about your situation from a lawyer licensed in your jurisdiction.

No attorney-client relationship

Using this website, sending us an email, calling, or submitting the contact form does not create an attorney-client relationship. That relationship begins only when the firm agrees in writing to represent you. Until then, what you send us may not be treated as privileged or confidential, so please do not send confidential or sensitive information before we have agreed to represent you.

Attorney advertising

This website is attorney advertising. David J. Jencks is the attorney responsible for its content and is admitted to practice in South Dakota. The firm does not seek to represent anyone through this website where the site would not comply with local rules. Hiring a lawyer is an important decision that should not be based on advertising alone. If you ask, we will send you written information about the firm’s qualifications and experience.

No warranties; limitation of liability

The site is provided “as is,” without warranties of any kind, express or implied. We try to keep it accurate, but the law changes, and we do not promise that the content is complete or current. We may change the site at any time without notice. You use the site at your own risk. To the extent the law allows, Jencks Law, P.C. is not liable for any damages arising from your use of the site, including errors or omissions, viruses, or technical problems.

Intellectual property

The text, images, design and other material on this site are owned or licensed by Jencks Law, P.C. and are protected by copyright and other laws. You may view, download, print and share the material for your personal, non-commercial use, or for internal use within your organization, as long as you do not change it and you keep all copyright and other notices. Any other use requires our written permission.

Email and electronic signatures

Email from the firm may contain privileged or confidential information intended only for the named recipient. If you receive one by mistake, please tell the sender and delete it, and do not read, copy or forward it. Email is not always secure, so consider other ways to send sensitive information.

An email from the firm, or a name, signature block or other electronic signature in it, is not intended as a binding signature or as agreement to any matter unless the message expressly says so.

Client privacy

If you are a client, we collect nonpublic personal information, including financial information, that you give us or that we obtain while providing the legal services you requested. We use and disclose it only as needed to provide those services, for example to firm staff, or to others such as your accountant or insurer when your matter requires it. We maintain physical, electronic and procedural safeguards consistent with the professional rules that govern lawyers. You may direct us not to share your information with others; just tell the attorney handling your matter.

Website privacy

If you contact us by email or through the contact form, we use the information you provide to respond to you. The site is hosted on WordPress.com, which may collect basic analytics such as the time of your visit, the pages you view and information your browser provides. We use that information to understand how the site is used and to improve it. We do not sell personal information. We take reasonable steps to protect information, but no website or internet transmission is completely secure.

Third-party links and X content

This site links to other websites and embeds content from X, including the @jenckslaw timeline and share buttons. Those sites and features are run by others, and their own terms and privacy policies govern what they collect and how they use it. We do not control and are not responsible for their content or practices.

Governing law

These terms, and any dispute about this website or your use of it, are governed by the laws of the State of South Dakota.

Changes to these terms

We may update these terms from time to time. Changes take effect when they are posted on this page, and the date at the top shows the latest revision.
