David J. Jencks

David J. Jencks, shareholder and senior counsel, serves as President of the law firm of Jencks & Jencks, P.C., concentrating in the areas of commercial transactions and litigations, transportation, business, estate planning, and municipal law.

David earned a Bachelor of Arts Degree at University of South Dakota and he holds a Juris Doctorate from Hamline University.

David has authored several articles on topics of transportation finance law and topics. David is pleased to be a regular contributor to International Factoring Association and the American Factoring Association training classes, newsletter, meetings and annual conferences regarding issues in transportation finance.

The majority of David’s practice involves working with factoring companies. In particular, David works with factors with transportation portfolios or those niche factors specializing primarily or exclusively in transportation. David currently works with approximately 30 factors in transportation factoring. He regularly assists with issues ranging from contract documentation, due diligence with prospects, best practices, field examinations, collections, and litigation, and personnel training.

David also lobbies for finance and transportation associations in state and federal legislature bodies.

Mr. Jencks also provides in house consultation services regarding operations, underwriting, marketing and managing factoring documentation and associated transportation documentation.

David currently serves as the City Attorney for the City of Madison and the City of Howard, South Dakota. David has served as a Trinity Lutheran Church trustee and vice president, president of the Madison Area Chamber of Commerce, president of the Interlakes Area United Way Board, and a board member of Refuge Youth Ministries. David and his wife, Rachael, practice law together and have four beautiful children, Marissa, Whitney, Ryan, and Ainsley.

Rachael A. Jencks

Rachael Lenzmeier Jencks, an attorney and Certified Public Accountant, is a shareholder and founding partner of the law firm of Jencks & Jencks, P.C., concentrating in the areas of tax, business and family law. Rachael received her Juris Doctorate from Hamline University, her Masters of Business Administration degree from the University of St. Thomas, and became a Certified Public Accountant in 2004.

Rachael has been an adjunct professor of accountancy and law at Dakota State University, Colorado Technical University, and the University of Phoenix.

Rachael’s law and accountancy practice focuses on tax planning for individuals and small business, business governance with respect to monthly, quarterly and yearly tax reporting, taxation election issues with S status entities, and assisting individuals and businesses in the preparation of financial statements, monthly financial records and all types of tax returns. Rachael’s accountancy skills are also used in assisting with field examinations for the firm’s finance clients.

Rachael also represents individuals in divorce, custody, visitation, child support, parental rights terminations, abuse and neglect proceedings, adoption and surrogacy proceedings. Rachael is also a court approved mediator with a mediation practice focusing primarily on domestic relations disputes such as custody and visitation.

Rachael is the mother of four beautiful children, Marissa, Whitney, Ryan, and Ainsley. She is married to her law partner, David.
